In terms of the Employment of Educators Act No. 76/1998, in particular section 6, 7 and 8, governing bodies play an important role in the appointment of educators in departmental posts. Section 6 of the Employment of Educators Act 76/1998 stipulates that any appointment, promotion or transfer of educators in public schools must be done by the governing body. In doing so, the governing body must ensure compliance with the principles of equity, redress and representivity. Furthermore the governing body must submit a list of at least three (3) names or less to the Head of Department in order of preference after which the HOD will make an appointment.
